N.C. Appeals Court rules that judges erred in child custody cases
Source: The Fayetteville Observer, N.迷你倉最平C.Nov. 06--Two judges in the Cape Fear region wrongly took children away from their parents in custody cases, the state Court of Appeals said in rulings Tuesday. The cases are from Robeson and Cumberland counties. The rulings don't necessarily indicate that the parents will regain custody of their children, just that the judges didn't take them away correctly. In the Robeson County case, a girl in 2010 was determined to have been neglected. She was put in foster care, and this year District Court Judge Herbert Richardson permanently ended efforts to return her to her parents. Her father is trying to get custody. The Appeals Court said records show that Richardson had no evidence to support taking the child. It overturned his decision and sent the case back to Robeson County for further conside迷你倉ation. In the Cumberland County case, District Court Judge John Dickson ordered a child to be raised by her paternal grandparents in Michigan and allowed her father unlimited visitation. Her mother was allowed to see her only four hours per month, and under supervision. The mother challenged the decision. The Appeals Court said Dickson did not make the necessary findings to support his decision to transfer the case to Michigan and did not create an adequate visitation schedule for the mother. The case was sent back to Cumberland County District Court.Staff writer Paul Woolverton can be reached at woolvertonp@fayobserver.com or 910-486-3512.Copyright: ___ (c)2013 The Fayetteville Observer (Fayetteville, N.C.)
